What are cookies?
Cookies are small text strings that websites visited by the user send to their device, where they are stored to be retransmitted to the same websites upon the user’s next visit.
For the purposes here, cookies are distinguished into technical cookies and profiling cookies, depending on their function, and into first-party cookies and third-party cookies, depending on who installs them.
Technical cookies
Technical cookies are used solely to “carry out the transmission of a communication over an electronic communications network, or strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide that service” (see art. 122, paragraph 1 of the Privacy Code).
Technical cookies are distinguished into navigation or session cookies (which guarantee normal navigation and use of the website), analytics cookies (considered technical cookies when used directly by the website operator to collect aggregated information about the number of users and how they visit the site), and functionality cookies (which allow users to navigate according to selected criteria such as language, to improve the service provided).
The installation and use of technical cookies do not require the prior consent of the data subject.
Profiling cookies
Profiling cookies are used to send advertising messages in line with the preferences expressed by the user during web browsing.
The use of profiling cookies requires the user’s consent.
Third-party cookies
Considering the different entity that installs cookies on the user’s device — whether it is the same website operator or a different site installing cookies through the first one — a distinction is made between first-party and third-party cookies.
